Terms of Service

Article 1 – Application

1. These Terms define the rights and obligations between us and users regarding the use of this Application.
2. By downloading, installing, or using this Application, users are deemed to have agreed to all the contents of these Terms.
3. If the content of these Terms differs from other descriptions of this Application, these Terms shall take precedence.

Article 2 – Definitions

1. "This Application" means OshiVista and related services.
2. "User" means all individuals who use this Application.
3. "Oshi Subject" means celebrities, idols, voice actors, VTubers, and other public figures that users register and manage.
4. "User Data" means all information (Oshi Subject information, event information, photos, notes, etc.) that users create, register, and save.

Article 3 – Service Content

1. This Application provides services for managing information about Oshi Subjects, checking event schedules, and recording memories.
2. Main features include: registration and management of Oshi Subjects, event schedule management, memory recording with photos and notes, AI-powered information retrieval, and calendar integration.
3. This Application uses external services (OpenAI, Perplexity, Firebase, etc.) for some features, subject to each service's terms.

Article 4 – Free Service and Advertising

1. All features of this Application are provided free of charge. This Application does not offer in-app purchases.
2. This Application displays advertisements delivered through Google AdMob, a third-party ad service provided by Google LLC.
3. Each calendar update (retrieval of event information by AI) is carried out only after the user has watched a video ad to the end. If the video ad is closed before it finishes, or if no ad can be loaded, the calendar is not updated.
4. The number of calendar updates available per day is limited.
5. Ads are delivered by a third party, and we do not guarantee that ads will always be available. When no ad can be served, calendar updates may be temporarily unavailable.
6. Features and limits may change without prior notice as we improve the service.

Article 5 – Terms of Use

1. Users shall use this Application in compliance with these Terms and applicable laws.
2. Users shall use this Application at their own responsibility.
3. Users shall prepare necessary equipment, software, and communication means at their own expense.
4. Some features require an Internet connection. Communication costs are borne by the user.

Article 6 – Prohibited Activities

1. Acts violating laws or public order and morals
2. Acts infringing upon intellectual property rights, portrait rights, privacy, or other rights of third parties
3. Acts that place an excessive burden on or interfere with the operation of this Application
4. Unauthorized access or impersonation
5. Reverse engineering, decompiling, or disassembling this Application
6. Other acts deemed inappropriate by us

Article 7 – Handling of User Data

1. Intellectual property rights in User Data belong to the user or rights holders.
2. User Data is stored locally on the user's device. We have no obligation to back up User Data.
3. Users shall back up their data regularly at their own responsibility.

Article 8 – Disclaimer

Article 9 – Changes & Termination

1. We may change or terminate this Application without prior notice.
2. Our liability for damages resulting from such changes or termination is limited to the extent set out in Article 10.

Article 10 – Limitation of Liability

The developer is liable for damages incurred by a user in connection with the use of this Application only where such damages are caused by the developer's willful misconduct or negligence.

Where damages are caused to a user by the developer's negligence (excluding gross negligence), the damages the developer compensates are limited to ordinary and direct damages actually incurred by the user, up to a maximum of JPY 1,000.

The limitation in the preceding paragraph does not apply to damages caused by the developer's willful misconduct or gross negligence.

Article 11 – Exclusion of Anti-Social Forces

Users represent and warrant that they are not organized crime groups, their members, associate members, related enterprises, corporate racketeers or equivalent parties, and have no socially condemnable relationship with such parties. If a breach becomes apparent, the developer may suspend use of the app or take other necessary measures without prior notice.

Article 12 – Prohibition of Assignment

Users may not assign, transfer or pledge their status under these Terms or any rights or obligations hereunder without the developer's prior written consent. If the developer transfers the business relating to this app to a third party, the developer may transfer its status under these Terms, the rights and obligations hereunder and user information to the transferee, and users consent to this in advance.

Article 13 – Severability

Even if any provision of these Terms or any part thereof is held invalid or unenforceable under applicable law, the remaining provisions remain in full force and effect. The invalid part is construed, to the extent permitted by law, in the manner closest to its original intent.

Article 14 – Governing Law and Jurisdiction

These Terms are governed by Japanese law. In the event of a dispute regarding this app, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
